These terms and conditions outline the rules and regulations for the use of Mr. Patties’s Website, located at http://delivery.mrpatties.com/.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

AVAILABILITY & DELIVERY

Delivery times stated on our Website or via Email are an indication, and although we try our best they do not a guarantee of delivery within these hours. We reserve the right to deliver your order at any point following your dispatch confirmation.

Delivery will be completed when our authorised courier company, deliver the Products to the address provided during the checkout process. Due to the nature of our goods being perishable, if for some reason no one is available at your address to take delivery our authorised courier company will leave your parcel in as safe as a place as possible as a second delivery attempt will not be possible. Our courier provided inflight options to provide instructions for a safe place or to leave your parcel with a neighbour, if you do not believe you will be present to receive your parcel, please use these inflight options where relevant.

We will always try our very best to follow any delivery instructions you provide and will ensure they are clearly visible on your package, however our courier company cannot be guaranteed to meet these instructions should their be a viable reason.

Our obligation to deliver your order shall be fulfilled once the courier delivers the order to you, if the order is considered safe by the courier or if the order is left with a Local Access Point.

Mr. Patties will not attempt a further delivery should your delivery fail, and you are obliged to bear all expenses related to aforesaid default of acceptance.

Should you decide to use the inflight options via your DPD/Royal Mail tracking code, Mr. Patties is not liable for any spoilage or damage caused to your parcel. We are not liable when a customer selects a different delivery date, we are not liable for customers not providing details of a safe place for their parcel to be left, we are also not liable should the customer choose for their parcel to be delivered to an address that was not provided during checkout.

All orders will be delivered within a perishable time frame of 72 hours, using relevant packaging and protective measures as per FSA Guidelines.

If there are unforeseen circumstances or delays within our courier delivery network, please be assured that your order will be delivered as soon as possible and will still only be delivered within the perishable timeframe of 72 hours.

Due to the nature of our goods being perishable all orders must be delivered by our courier partner on the first attempt and cannot be taken back to a depot, and should there be nobody available to accept an order at the specified delivery address, it is in the couriers discretion to leave the parcel(s) in a place they deem to be safe. If no viable safe place is available, parcels may be left on the doorstep of the specified delivery address.

Mr. Patties reserves the right to change your delivery date with prior notice given to you as soon as we possibly can. If your delivery is left delivered to a neighbour or Local Access Point and they are stolen or damaged, we cannot not accept liability, however we may offer you a refund or other form of compensation but this is at our complete discretion.

Standard Delivery: Your patties will be freshly packaged in polypropylene sheets and then into a regular cardboard box without any thermal polystyrene or ice packs. This means your patties are not suitable for refrigeration and should be consumed immediately.

Any food product should be shipped in as fast a manner as possible, in turn we are not liable for any spoiling of goods after 24 hours following successful delivery when using standard delivery. This option is for customers that want to consume their patties immediately following delivery.

Premium Delivery: Your patties are individually flow-wrapped using Polypropylene sheets, before being freshly packed for shipping in quantities of 12 using cardboard boxes and ice packs.

Our Premium orders are shipped on a next day service, however external circumstances can cause delays in some instances. Should this occur please be assured that your order will still be delivered in its required perishable timeframe.

You can freeze your patties on the day of delivery to keep them for up to 6 months, or you may store your patties in a refrigerator for up to 3 days at a temperature between 1-5°C and no lower than -12°C.

Express delivery is available for all orders. 

Orders placed before 9am will be delivered via Next Day Delivery.

PRODUCT AVAILABILITY

Products are subject to availability and market conditions. Should there be non-availability of any Products you order, we will try our best to offer a reasonable substitute. It is always our policy to contact you and notify you of any substitute items via email or phone call prior to delivery when possible, giving you the chance to accept or reject the item prior to the completion of delivery. If you are not happy with any substitution, please contact us.

PAYMENTS

Payment details are processed by a third party payment processors and no data is stored. Further details are set out in our privacy policy available on our Website. Mr. Patties does not have access to view your full credit or debit card details at any time.

We reserve the right to withdraw your order should we suspect any form of fraudulent activity. 

EVENTS OUT OF OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”).

  • A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: 
  • Strikes, lock-outs or other industrial action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; 
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; 
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; 
  • Impossibility of the use of public or private telecommunications networks; 
  • The acts, decrees, legislation, regulations or restrictions of any government; and
  • Pandemics or epidemics.

DISCOUNT VOUCHERS

A Discount Voucher may only be used once by its Holder and may not be copied, reproduced, distributed or published either directly or indirectly in any form, nor shall it be stored in a data retrieval system without prior written approval from Mr. Patties.

Any discounts attained via Discount Vouchers apply to the price of the Products ordered only and does not apply to any delivery charges, which will still be chargeable at the normal rate.

We reserve the right to withdraw or deactivate any Discount Voucher for any reason at any time.

We reserve the right to cancel Discount Vouchers at any time. We also reserve the right to reject Voucher codes if we suspect any type of fraudulent activity. 

REFUND POLICY

If you are unhappy with your delivery for a legitimate reason such as: the order was missing items, the order was damaged or the order did not arrive, we will offer an appropriate refund as long as it can be shown that the order you were charged for was not supplied as it should have been.

As our Products contain fresh and perishable food, you are not entitled to the regular rights of consumers to return goods within 14 days after you receive them simply because you change your mind. There is an exemption pursuant to regulation 27(1)(c) of the Consumer Contracts (Information, Deactivation and Additional Charges) Regulations 2013, that confirms that contracts for the supply of goods are exempt from the right to withdrawal if those goods are liable to deteriorate or expire rapidly.

We employ the use of cookies. By accessing Mr. Patties, you agreed to use cookies in agreement with the Mr. Patties’s Privacy Policy.

Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.
